1.1 We understand that, when you sign-up with GIM, a mobile application and web-based solution platform from EJOGAJOG, and use our services, you trust us with your information and data. Ensuring the privacy and security of the information that you share with us is one of our top priorities. This Privacy Policy provides you with information on when and how we collect, retain, use, transmit and/or protect information that you share with us via the website, mobile application or any other platforms owned or operated by GIM (“Platform”), and the other privacy practices and your choices regarding these information.

1.2 The Privacy Policy applies to any person who avails our services, visits our website or uses our mobile application anywhere in the world, including, but not limited to, the vehicle drivers, vehicle owner, transportation companies (and their respective corporate representatives) and other delivery partners, the delivery recipients, and any person who, or entity which, provides information to us in connection with our services (collectively, “User(s)” or “you”).

1.3 We are not responsible, and shall not be held liable, for any privacy statement made on any website, mobile application or other platform not owned, operated or substantially controlled by us or communicated to you via e-mail or any other medium. For the avoidance of any doubt, you acknowledge and understand that we, at GIM, shall not be held liable for the actions of third party individuals or entities in any manner whatsoever.

1.4 We reserve the right to amend this Privacy Policy from time to time, without prior notification to you. Such amended Privacy Policy shall be deemed to be effective and binding on you from the time it was posted on the Platform. You hereby acknowledge and agree to keep yourself updated of changes to the Privacy Policy.

1.5 The terms and expressions used in this Privacy Policy, and not otherwise defined herein, shall have the same meaning given to it in the Terms of Use of our Services.

1.6 Notwithstanding anything contained anywhere in this Privacy Policy or Terms of Use, you are solely responsible for the accuracy of the information that you provide to us.

2. INFORMATION WE COLLECT AND RETAIN
2.1 We collect, retain, store and/or use information which you provide in the course of creating or updating your account to avail our services, which includes, but is not limited to, your name, date of birth, gender, payment information (including, where relevant, payment verification information), vehicle information (such as vehicle registration number, driving license, fitness papers, insurance, route permit, etc.), contact details (such as mobile number, e-mail address and office or residential address), the national ID card or passport or any other ID document evidencing information that can be used to contact or identify you, and any other information required to be collected and retained by us under applicable laws or government policies or in order to provide our services to you or to any of our Users. Such information and data will be collected from you on the basis of this Privacy Policy.

2.2 We may collect information that you provide when you contact our customer support service, provide ratings or comments to other Users, comment on any of our Platforms, surveys you may have completed, as well as the history of your usage of our services, website or mobile application and associated information (including senders’ and recipients’ location and other details), information captured and stored by your web browser or mobile operating system (such as language preference, software and hardware attributes, IP address, device location and other demographic information, cookies, etc.), information gathered by Google Analytics or any other analytical software, your contact address books, calendar, and any other information you may allow us to access.

2.3 We may collect information on your approximate or precise location, depending on the nature of the services you are availing from us and your device settings and permissions. Such information may be obtained through the Wi-Fi connection you are using, your IP address and/or the GPS. We collect such information, in cases of mobile device, when the mobile application is running in the foreground or background. You may refuse to give us permission to, or withdraw permission from, collecting such information at any time by disabling our permission from your mobile device. In such cases, you may either be unable to use our services or the functionality of the website or mobile application and your use of its features may be restricted, for which we will not be liable in anyway. Even if you have disabled our access to such information, we may obtain information about your approximate location if you are using our services from other Users.

2.4 We collect details of your transaction in our Platform, which may include, but is not limited to, information on the services you avail, the payment being made or received, delivery information, the date and time of the services and the distance travelled.

2.5 We may use third party analytics, such as Google Analytics or Kissmetrics or any other analytical software, to analyze the activities of visitors to our website. Where information is shared with such third parties, the privacy policies of such third parties shall govern the use and retention of your information to the extent the information is shared.

2.6 We use cookies to collect information on traffic patterns on the website, IP address and/or location of visitors, web logs, number of visits on the website, and other communication data. This allows us to deliver better, faster, safer and more personalized experience and customized contents, services and advertisements to the Users.

2.7 We may also collect other information anonymously to improve our service and the quality of our Users’ experience.

2.8 We may, where necessary or expedient, independently collect, or request you to provide, further additional information (such as background information on you to ascertain your driver’s history or criminal records) from time to time.

2.9 In availing our services, you may be introduced to third party service providers through the Platform. The privacy policies of such service providers are not under our control, and therefore any interaction with, or collection and retention of information by, such service providers shall be governed by their privacy policy and we shall not, under any circumstance, be responsible for breach of privacy or security of information, if any. For the avoidance of any doubt, our association with any third party service provider do not make us liable for any breach of privacy or security of information by such service provider.

2.10 We do not collect personal information such as your race, religion, political affiliation or medical information. However, any such information we obtain incidentally shall be afforded same protection as other information we collect and retain.

2.11 We may require additional information from time to time to, for instance, run promotions or conduct surveys. In such cases, you will have the choice to decide whether to provide such information or not. If you decide to provide such information, it shall be shall be afforded same protection as other information we collect and retain.

3.CONSENT
3.1 You agree that the data and information that we collect or otherwise receive through our websites, mobile application or any other platform owned, operated and/or controlled by us may be used for the purposes described in this Privacy Policy or the Terms of Use, or disclosed where such disclosure is necessary or required under any applicable laws or by any law enforcement agency.

3.2 You may refuse to provide us with information which are necessary to provide our services, or withdraw your consent for us to collect, retain, use or disclose such information by giving reasonable notice. In such cases, you shall no longer be able to use the services or the Platform.

3.3 Unless you choose to opt out, you agree to us using third parties, such as Google, for advertisement on the Platform and to sharing certain information for such advertisement purposes.

3.4 You can block or disable cookies from the website. If you choose to do so, it may interfere with the functionality of the website and your use of the website’s features may be restricted.

3.5 You reserve the right not to provide us access to certain information, such as your mobile calendar, contact address books, camera and gallery. In such cases, you should disable our access to such information on your mobile or computer device manually. If such restriction prevents or hinders us from providing the services, you may no longer be able to use the services or the Platform.

3.6 You agree that the information provided by you to us are correct and up-to-date at all times whilst you use our services. In the event any information is no longer current, you agree to update such information immediately. If you want us to remove any particular information from our records, please send us your request at help@gim.com.bd with full particulars of the details you would like to have removed, and we shall endeavor to comply with such request to the fullest extent permitted by the applicable laws.

3.7 We may share your data collected not pursuant to, or otherwise not covered under, this Privacy Policy after prior notification to you. If you do not want your data to be shared, you may have to cease to use our services. We encourage you to speak to one our customer service support staff before you opt out of our services.

4.DISCLOSURE
4.1 We may disclose information we collect about you, and you hereby agree to such disclosure, if (i) we are obligated to do so under the applicable laws, to the extent such disclosure is necessary, (ii) we are obligated to do so by an order of the law enforcement agency or any governmental agency, to the extent such order requires disclosure, (iii) we are obligated to do so by a court, to the extent the order of the court requires disclosure, or (iv) we consider it to be necessary to prevent any unlawful activity or to address any safety or security concern.

4.2 We reserve the absolute proprietary rights over all information and data we collate and store in our system and may share or sell such data or information, to the extent it is necessary, if GIM / EJOGAJOG enters into any business transaction, such as merger or acquisition with another person or company. You will be notified about any such change in control or ownership of your information via e-mail or any other medium, but such notification or receipt thereof shall not affect the sharing or selling of such information or data.

5.DURATION OF RETENTION
5.1 We endeavor to collect, retain and/or use the information only for the purposes for which it is collected or as stated herein or the Terms of Use. We will retain your information for as long as it is necessary to provide you and our Users services or as required by the applicable laws.

6.HOW WE MAY USE THE DATA
6.1 We will use the information we collect, such as your name, date of birth, vehicle information, contact details and the national ID card or passport, to verify your identity and keep the same in our records for security and safety reasons.

6.2 We will use the information you upload in your account and your location data in order to provide our services to you, which includes tracking your movement or the movement of goods sent through our platform using its precise or approximate location information or, for instance, to provide you with ready access to your previous locations.

6.3 We will use your name, contact number and e-mail address to connect you with other Users. For instance, if you are a partner driver providing a confirmed transportation service (such as courier or delivery service) to one of our Users, we will use your number to allow the User to contact you or provide the User’s number to allow you to contact him or her. Similarly, if you are a delivery recipient, we may provide your number or e-mail address to our partner driver to enable him or her to contact you. Your number may also be used to provide you with information on the shipment and the expected time of delivery. We may additionally use your contact number to confirm or notify you about any transaction carried out in our Platform, or to send you promotional and other messages. We may also use your e-mail address to send you newsletter or other information periodically. You will have full control over whether to receive such newsletter or information, and can change your preferences or unsubscribe at any time. Your contact details may be used for us to provide customer support services from time to time. Please be mindful that, if you have provided an incorrect e-mail address or phone number (or if these details have been changed without prior notification to us), then you may not receive these communications, or any other communications, and GIM shall not be responsible for failure to communicate such information or for any communication going to an incorrect e-mail address or phone number.

6.4 We will disclose certain information with our Users availing our services, such as your name (either first name or full name), the vehicle model, colour or license number, ratings and comments, etc. to allow such Users to identify you using our Platforms. 6.5 We will use ratings and comments posted by other Users on you to identify unsafe drivers or driving behavior, or to carry out user profiling, or to allow the affected Users to improve its rating on our Platforms, or to assess the quality of our services.

6.6 We will use your payment details to facilitate and process payments for services being availed through our Platform. We may also use your transaction history and payment details, where necessary, in order to detect, avert and combat any illegal activity, and provide the law enforcement agencies with assistance if so required to do so.

6.7 We may use information we collect for safety and security purposes and to carry out research and analysis and product development to provide you with improved services. 6.8 We may use some information that we collect for advertisement or promotional purposes. We may also use some information to inform you about our products, services, surveys, promotions and other updates. However, we will not disclose any personally identifiable information relating to you which may expose you to any security risk.

7.INFORMATION SHARING WITH THIRD PARTIES
7.1 We may share or otherwise provided restricted access certain information that we collect with our partner companies, third party business partners and other affiliates, whether in Bangladesh or abroad, to assist us in providing our services, to design and operate our Platform, to store, process or analyse the data, to place cookies on your computer to assist us in analysing data usage, or to provide data storage. These third parties can only use the information we share for only those purpose for which it was provided, and, for the avoidance of any doubt, such information will not be permitted to be used for any independent commercial purpose.

7.2 We may, from time to time, contact you on behalf of third party business partners and other third parties about offers that may be of interest to you.

8.YOUR RESPONSIBILITY
8.1 You shall at all times be responsible for the protection of your account ID, log-in password and reset information, and all other sensitive and personal information that you provide to us (for instance, copy of the nation ID card or passport). We do not and we will not, at any time, request your payment details, account ID, log-in password, reset information, mobile number or any other sensitive and personal information relating to you or your account via e-mail or telephone communication. If you receive any such communication, you are advised to contact us immediately at help@gim.com.bd.

8.2 You must be at least 18 years of age to register on our Platforms or use our services. We do not knowingly collect or retain information of any person under the age of 18 and if any such information is collected or retained in our system, please inform us at help@gim.com.bd with the account details and other particulars, and we shall endeavor to remove such information from our system as soon as possible.

8.3 Notwithstanding anything contained in this Privacy Policy or the Terms of Use, you shall at all times be responsible for the data that you provide to us or otherwise make available on the Platform, and shall solely be liable for any civil claim or criminal prosecution for any content made available by you on the Platform or otherwise to us. For the avoidance of any doubt, you shall be solely liable for posting any offensive, derogatory, defamatory or otherwise any criminal contents on the Platform, or for making unauthorized use or collection of any contents posted on the Platform, or for any false and/or incorrect information of or relating to you, and, without prejudice to the foregoing, for all such other data and information that is supplied to us by you directly and knowingly or otherwise. GIM shall under no circumstance be held, or deemed to be, liable for any content which violates the applicable law.

9.JURISDICTION
9.1 GIM operates its website and mobile application from Dhaka, Bangladesh. This Privacy Policy is subject to the laws of Bangladesh and the terms and condition provided herein are deemed to have been expressly accepted on you using our Platforms or services. If any information subject to the provisions of this Privacy Policy is stored outside Bangladesh, the applicable data privacy laws of that jurisdiction shall apply to it provided its application is mandatory requirement under the law of that jurisdiction, and the application of the law of that jurisdiction shall at all times be in consonance with the laws of Bangladesh.

9.2 We reserve the right to transfer your information to any country outside Bangladesh to the fullest extent permitted by the laws of Bangladesh.

9.3 Reference to the “applicable law” in this Privacy Policy or the Terms of Use shall mean and include the law of Bangladesh and all other jurisdictions.

By continuing to use our services and the Platform, you hereby expressly and unequivocally accept that you have (a) read and understood the terms and conditions of this Privacy Policy and any other terms and conditions that may be applicable to you, and (b) agreed to us collecting, retaining, using, supplying and/or transmitting your data and information of such nature, and in such manner, as stated herein above, and that such acceptance constitutes a valid authorization for us to collect, retain, use, supply and/or transmit your data and information under the applicable laws.
